Teacher Tenure

The firm provides full service to school districts in all matters relating to employee discipline for teachers, support staff and administrators. We regularly represent school districts in due process hearings, both before the board of education and in arbitration hearings. We regularly practice before the Michigan State Teacher Tenure Commission and in connection with subsequent appeals. We draft and review documents related to employee disciplinary proceedings including disciplinary memos, plans of assistance, and directives and any other documentation which becomes necessary.

Representative cases before the Michigan Court of Appeals on tenure matters include the following:

  • Beebee v Haslett Public Schools, 406 Mich 224 (1979), establishing the initial parameters for finding of teacher incompetency.
    Halm v Board of Education of Dansville Agricultural Schools, 174 Mich App 520 (1988). This was an appeal from the Tenure Commission of a teacher’s discharge.
  • Oates-Ulrich v Okemos Schools Board of Education, 163 Mich 587 (1987). We defended a school district’s position that a school psychologist and social worker are not protected under the Teachers’ Tenure Act.
